FLORALIS Club Regulations

Welcome to the Floralis private customer club (hereinafter: the Club)

1.   General

1.1 This regulation is intended to regulate the rules by which the Club operates.

1.2 The Club refers to Floralis-owned physical stores and does not include the online store.

1.3 Floralis reserves the right to change the terms of these regulations, including the point accumulation method, from time to time at its sole discretion.

1.4 For convenience only, these regulations are written in the masculine form. Everything written in the masculine form should also be considered correct in the feminine form.

 

 

2.   Definitions

2.1 A qualifying purchase accumulates points. For this matter, a purchase is made using payment methods accepted by the company: cash, credit card, checks, and bank transfer.

2.2 It is clarified that not every purchase will be a "qualifying purchase" and that the products whose purchase will be considered a "qualifying purchase" will be determined on an ongoing basis by Floralis, at its sole discretion.

2.3 The Club member will not have the option to choose whether the purchase he makes will be considered a "qualifying purchase," as defined above, or not.

2.4 Club membership is valid for one year from the day the Club member joined the Club, unless Floralis decides otherwise.

 

3.   Joining and Membership in the Club

3.1 Club Member

3.1.1 Any private individual aged 18 and over, who has filled in their personal details in the Club membership application form, has met all Club conditions in accordance with these regulations.

3.1.2 It is clarified that each person may join the Club once.

3.1.3 Membership is conditional on filling out a digital application form for Club membership at one of Floralis's physical stores, which includes the following details: full name, date of birth, ID number, mobile phone number, email, date, and consent to receive mailings from Floralis.

3.1.4 Club members' details will be stored in writing and/or on magnetic media and also in the company's database according to Floralis's decision from time to time.

Membership is voluntary and can be canceled at any time according to the provisions of the regulations.

  

4.       Use of the Club

4.1 The Club is personal and limited to private customers only who are not business customers. It should be emphasized that the Club is not transferable or usable by or through another person.

4.2 Club membership grants benefits only at Floralis-owned stores, excluding the online store, outlet stores, and surplus items.

4.3 It is hereby clarified that if additional physical stores are added, the Club will also be valid in these stores (according to Floralis's decision) and excluding surplus/outlet stores. The list of stores where the Club can be used will be compiled by Floralis and updated by adding and/or removing stores according to Floralis's decision from time to time and subject to these regulations. The updated list of stores will be available for viewing on the company's website www.floralis.co.il

4.4 The membership card is digital and is not a "debit card" as defined in the Debit Card Law, 5746-1986.

 

4.5.  Accumulation and Redemption of CASH BACK Points

4.5.1 Accumulation and redemption of points will be possible by identifying as a club member, and is conditional on presenting only a valid ID.

4.5.2 Redemption of points accumulated as a club member is valid in Floralis stores only and does not include the online store.

4.5.3 As a club member, you can accumulate and redeem points when purchasing in stores, with the exception of surplus items as defined in the store (outlet).

4.5.4 CASH BACK points are personal points, each worth 1 NIS, which are accumulated by the club member and in any case, are not transferable and/or cannot be combined and/or converted to cash and/or credit and/or

according to any law.

4.5.5 Club members will be allowed to accumulate CASH BACK points or redeem CASH BACK points and/or enjoy club promotions and/or any other activity related to the club only within a transaction made in cash and/or by credit card and/or by checks and/or by bank transfer and/or according to any law.

4.5.6 The validity of using accumulated points is up to 3 years from the date of accumulation, even if the customer has not renewed their club membership. This means that the customer can and may use their personal points in the club for a purchase at one of Floralis's stores even if they decided not to renew their club membership. Floralis may decide otherwise at any stage it deems appropriate.

4.5.7 Floralis may change the rate of CASH BACK points accumulated in any qualifying purchase from time to time, at its sole discretion, including within the framework of various promotions and benefits, subject to all law.

4.5.8 Not all products can be fully and/or partially redeemed with CASH BACK points. Floralis will continuously and exclusively determine which products can be redeemed with CASH BACK points and which products cannot be redeemed.

4.5.9 Club membership will entitle its members to enjoy double promotions unless otherwise decided by Floralis. For the avoidance of doubt, it is clarified that club members will be allowed to accumulate points and/or redeem CASH BACK and/or redeem the birthday benefit concurrently and cumulatively with Floralis promotions, if any, at that time, unless otherwise decided by Floralis and at Floralis's sole discretion.

4.5.10 In the event that a club member utilized more CASH BACK points than due to him, including a malfunction or disruption in Floralis's computers, Floralis may demand a refund of 1 NIS for each CASH BACK (credit points) utilized by mistake, in order to cover the point deficit.

4.5.11 The price that determines the accumulation of CASH BACK points will be the price actually paid, except for products purchased by the customer at a discount (e.g., a damaged display furniture item) – no points are accumulated for these.

4.5.12 CASH BACK points cannot be redeemed in the same transaction in which they were accumulated, but only in a separate transaction 24 hours after its execution.

4.5.13 When purchasing products by redeeming CASH BACK points, no CASH BACK points will be accumulated.

4.5.14 When loading a gift card and/or purchasing other payment methods, the member will not benefit from club benefits, including accumulation, redemption, and the like.

4.5.15 Club promotions will not apply to loading gift cards and/or purchasing other payment methods. For the avoidance of doubt, it is clarified that loading a gift card will only be possible in cash or by credit card and for the full amount loaded on the card.

4.5.16 Accumulation and/or redemption of CASH BACK points will not be possible retroactively.

4.5.17 Transaction cancellation for items purchased as part of a qualifying purchase will be in accordance with Floralis's product return policy as updated from time to time and subject to the provisions of the Consumer Protection (Cancellation of Transaction) Regulations, 2010.

4.5.18 If a club member receives a credit for returning items purchased as part of a qualifying purchase, the credit points given for those items will be deducted/offset from the total credit points accumulated in their account up to that time. Upon redemption of the credit by the club member, the credit points will be returned to the member accordingly.

4.5.19 In the event that a club member is credited for the return of items purchased by another club member as part of a qualifying purchase, the credit points will be deducted from the club member who made the original purchase, and upon redemption of the credit, the same credit points will be given to the member redeeming the credit, provided that they identified as a club member at the time of credit redemption.

4.5.20 Cancellation of a transaction made using CASH BACK points and/or cash and/or credit card will be subject to the provisions of the Consumer Protection (Cancellation of Transaction) Regulations, 2011.

4.5.21 In the event that a customer who is not a club member is credited for the return of items purchased for them by a club member as part of a qualifying purchase, the credit points accumulated by the member who made the original qualifying purchase will be deducted and not reinstated.

4.5.22 The member will be entitled to review the information held about them in the customer club database, including receiving a report on the balance of CASH BACK points accumulated, by contacting customer service at service@floralis.co.il or by contacting one of the branches.

4.5.23 The record held by the customer club is what will determine the amount of CASH BACK points accumulated by each club member. The club's records regarding the number of CASH BACK points accumulated will serve as conclusive evidence of the accuracy of the details. It is hereby clarified that Floralis is exempt from liability towards the member in case of errors in point accumulation due to a technical and/or electronic and/or other malfunction.

4.5.24 A member who feels aggrieved regarding the amount of CASH BACK points accumulated, or any other matter arising from these regulations or the promotion, may contact Floralis's customer service department in writing to raise their objections.

4.5.25 The customer service decision, to be provided within 14 business days from the receipt of the objection, will be final and non-appealable.

4.5.26 In the event of fraudulent and/or unfair accumulation of CASH BACK points and/or for a transaction that was denied after the points were accumulated and/or in any manner not in accordance with the provisions of these regulations, Floralis shall be entitled to deduct the aforementioned CASH BACK points from the member's account.

4.5.27 Shipping/delivery fees paid for the purchase are not payable by CASH BACK.

4.5.28 No retroactive benefits will be given for qualifying purchases made before joining the club, or due to not identifying as a club member.

4.5.29 Floralis reserves the right to choose and change the mailing of promotions and benefits from time to time by any means, including SMS messages, mail, email, POS slips, and any other possible communication channels, subject to all laws.

 

5.   Benefits for Club Members; Accumulation and Redemption of "CASH BACK" Points

5.1  Birthday Benefit

5.1.1 A one-time redemption voucher for NIS 50, redeemable only in the birthday month.

5.1.2 Redemption of the birthday gift voucher is conditional on the physical presence of the club member, presentation of an ID and/or official document validating the club member's date of birth.

5.1.3 Redemption of the benefit is valid only at Floralis's physical stores and is not valid at the online store.

5.1.4 It should be emphasized that it is the responsibility of the club member to update the correct birthday date on the registration form. In the event that the birthday date does not match the date of birth appearing on the identification document, the club member will not be entitled to redeem the birthday benefit. Furthermore, in the event of such a discrepancy, the club member will be allowed to request to update the correct birthday date by contacting Floralis's customer service and presenting an identification document that includes, among other things, the club member's date of birth. If the member updates the correct birthday date, they will be allowed to redeem the birthday benefit starting from their birthday that occurs after the correct date (it will not be possible to redeem retroactively). The birthday benefit cannot be extended.

5.1.5 The birthday benefit comes into effect 24 hours after joining the club.

5.1.6 The birthday benefit will be available for redemption during the member's birthday month only,   

and will automatically expire at the end of that month.

5.2.  General Provisions for Birthday Benefit

5.2.1 The terms for transaction cancellation and use of the birthday benefit are subject to the provisions of the Consumer Protection (Cancellation of Transaction) Regulations, 2011.

5.2.2 Redemption of the birthday benefit as defined above (and as it may change in the future) will be considered a "qualifying purchase" as defined in these regulations only in relation to the amount actually paid in cash and/or by credit card and/or by checks and/or by bank transfer.

5.2.3 Also, during certain promotions in Floralis stores, the company will be entitled to limit the right of club members to redeem the birthday benefit.

5.2.4 Floralis reserves the right to change the benefits listed in these regulations at its sole discretion and without prior notice, subject to all laws.

5.2.5 It should be emphasized that the birthday benefit is personal and intended for club members only upon their joining the club.

     

6. Databases

6.1 By joining the club, the member agrees to be included in the registered database pertaining to the Floralis customer club.

6.2 It is clarified that the responsibility for filling in and updating the details on the application form rests with the member, who undertakes to provide only their correct and accurate details clearly and legibly. The member confirms that the details provided are correct, up-to-date, and complete, and he confirms that he will update on any change in these details. No claim will be heard against Floralis regarding non-receipt of mailings and/or club benefits due to error/partial filling/non-filling of identification details.

6.3 Subject to the provisions of these regulations, the member will be deemed to have voluntarily agreed that the personal data he provides as detailed above, as well as any information collected in connection with the club and/or any data generated based on the analysis of the aforementioned data and information, will remain in the possession of Floralis and/or anyone on its behalf, who may use them for contacting club members, managing and operating the customer club and marketing activities carried out by Floralis or anyone on its behalf, and will also be used by Floralis and/or anyone on its behalf to promote its activities, conduct data analysis and statistical research, and for direct mailing to club members.

6.4 For the avoidance of doubt, it is clarified that, in accordance with the Privacy Protection Law 5741-1981 and the regulations thereunder, the signature of members on the club membership application form, through which members give their consent to receive mailings, shall constitute consent to allow Floralis to use the data for mailing purposes and collaborations with other companies.

6.5 It is clarified that any information about a club member accumulated in connection with their club membership shall be considered the property of Floralis, and the member hereby waives any claim regarding the use of such information, including a claim under the Privacy Protection Law, 5741-1981, and the regulations thereunder. The company shall be entitled, but not obligated, to grant additional benefits, at its discretion, to members (all or some) approved for mailings in the club, in accordance with criteria determined by it from time to time.

6.6 Any member may request Floralis, by contacting service@floralis.co.il, that information related to the club pertaining to them be deleted from Floralis's database, subject to all law.

6.7 The member may request the removal of mailings from the customer club by any of the following methods:

     6.7.1 Sending "Remove" in an SMS message to the number appearing in the received message.

     6.7.2 In a newsletter message – clicking the "Remove" button attached to the sent email address.

6.8 Floralis reserves the right to extend or discontinue the club's activity with prior notice. Discontinuation of the club's activity by Floralis's initiative will allow the member to redeem the points/benefits accumulated as stated in these regulations, subject to all law.

 

7. Cancellation of Club Membership

7.1 Floralis shall be entitled to cancel a club member's membership and revoke any right arising from their membership, including rights and benefits accumulated prior to the cancellation of their membership, if they acted contrary to the provisions of the regulations and/or the law and/or made a wholesale purchase.

 

8. Miscellaneous

8.1 These regulations constitute a condition for joining the customer club, and every member is considered to have seen, understood, read, and agreed to the provisions of these regulations, including changes that will apply from time to time.

8.2 The club member is aware that Floralis reserves the right to grant additional benefits to some club members, at its discretion from time to time.

8.3 Floralis reserves the right to change the regulations from time to time at its sole discretion and without prior notice, subject to all law. An updated version of the regulations can be viewed at any of Floralis's stores and/or by direct contact to service@floralis.co.il and/or on the company's website.

8.4 Floralis reserves the right to change the benefits granted within the framework of the customer club from time to time at its discretion and without prior notice, subject to all law, and no club member shall have any claim in this regard.

8.5 In case of any contradiction and/or discrepancy between the provisions of these regulations and any other publications in any media, the provisions of these regulations shall prevail for all intents and purposes.

8.6 The methods of publishing club announcements shall be at Floralis's sole discretion.

8.7 When purchasing products, it will not be possible to use the club simultaneously with the use of any discount card whatsoever if the member possesses one, including benefit cards, and it is clarified that club members who possess discount cards (in addition to club membership) will be required to choose at the time of purchase which of the benefits/cards/forms they wish to use for that purchase.

8.8 The customer's signature on the club membership application forms constitutes agreement to all stated in these regulations, including any future changes to the provisions of the regulations. The club member shall have no demand and/or claim in connection with the regulations and/or changes to the regulations.

8.9 Any waiver or action by the club in favor of the customer contrary to what is stated in the regulations is ex gratia only and shall not be used or considered a waiver of what is stated in these regulations.

8.10 In the event of malfunctions that temporarily prevent the granting of benefits to club members, Floralis will work to correct the malfunctions as soon as possible, and club members shall have no claims and/or lawsuits against Floralis due to the non-provision of benefits during the period of the malfunctions and their resolution.
